Contract Terms & Conditions
The applicant acknowledging, by way of completing a PAR-q form, that he/she has no physical or mental limitations preventing him/her from participation must precede all services purchased from Tracey Mellor Pilates. All applicants under the age of 18 years must have consent, in written form, from a parent or guardian. The applicant also agrees to abide by the rules and regulations of the studio and acknowledges that these rules and regulations may change from time to time. Furthermore, all applicants release Tracey Mellor Pilates, its owners, directors, managers and all employees of all liability regarding 1) an injury to self or child 2) any loss or damage to personal property.
To register or purchase from the Tracey Mellor Pilates online booking system, you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete.

Privacy & Security Policy
Tracey Mellor Pilates will never sell trade, rent, exchange or otherwise share your personal information with any other person, company or organization.
Commitment to Data Security
Your personally identifiable information is kept secure. Only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information. All emails and newsletters from our sites allow you to opt out of further mailings.

Refund / Cancellation Policy

Services

• Private Training
If your scheduling conflict is known in advance and we are notified at least 24 hours ahead of time, it MAY be possible to make the session up at a later date or with a different trainer. However, this cannot be guaranteed.
If you are unable to attend a session due to circumstances out of your control (determined on a case-by-case basis by our administration), we can offer you an alternative session.
Any sessions missed with less than 24 hours notification are forfeited.
If you have not already paid for the session, your account/card will be charged for the full amount of the session. If no card/account information is present, no further sessions will be conducted until the outstanding payment is
received.
Additionally, reserved time slots may be lost if payment is not made in a timely manner.

• Classes
Pre-paid classes are refundable
If your scheduling conflict is known in advance and we are notified at least 24 hours ahead of time, it MAY be possible to make the session up at a later date or with a different trainer. However, this cannot be guaranteed.
If you are unable to attend a session due to circumstances out of your control (determined on a case-by-case basis by our administration), we can offer you an alternative session,
There is no refund for merely changing your mind!
We are here to get you results and these results cannot be achieved if you fail to attend the sessions This is not negotiable.
Any classes missed without 24 hours notification are forfeited.
If you have not already paid for the class, your account/card will be charged for the full amount of the session.

• Workshops
All workshop places need to be booked and paid for in advance.
If your scheduling conflict is known in advance and we are notified at least 72 hours in advance that you wish to cancel then a refund will be given subject to an administration fee of 30%.
If Workshop is cancelled 24 hours in advance a refund of 50 % will be given.
If workshop cancelled less than 24 hours in advance no refund will be given.

• Fitness Equipment and Accessories
May be returned within 14 days for exchange only. Returns are valid only for products that have not been opened, used or damaged.
Products which are defective or damaged upon arrival may be returned immediately for exchange.
Some products may need to be shipped directly to the manufacturer. This will be stated on the product package or instruction insert. Should you be unsure if this is the case, please contact us using the information at the bottom of this page
Customers are responsible for all shipping charges on exchanges or refunds.
Refunds are only available when an equivalent replacement in unavailable and customer does not wish to exchange
for another product

• Books, DVD's, Posters
May be returned within 14 days for exchange only. Returns are valid only for products that have not been opened, used or damaged.
Products which are defective or damaged upon arrival may be returned immediately for exchange.
Customers are responsible for all shipping charges on exchanges or refunds.
Refunds are only available when an equivalent replacement in unavailable and customer does not wish to exchange for another product.

• Digital Products (Audio, Video, E-Book downloads)
These products are not eligible for return or exchange.
Should your file be defective or damaged upon arrival please contact the appropriate division of the Tracey Mellor Pilates where you purchased the product and we will arrange for a copy of the file to be re-sent.
Should you be dissatisfied with the quality or content of the file, we would be happy to hear your feedback.

Studio rules and regulations

All participants must complete a PAR-q-form and attend an introductory session where safety in the studio will be discussed.
All participants should wear appropriate clothing, which will not cause offence to other participants or trainers.
All participants should act responsibly around the studio.
All participants should ensure they book in advance and pay for their sessions.
All participants must tell the trainer of any changes to health, physical and mental, since their last session.
All participants must pay attention to the trainer’s instructions at all times and any exercises undertaken without the trainer’s permission are done at the participant’s own risk.
The trainer is not obliged to teach the participant beyond the end of the scheduled class and can refuse entry if late in arriving or if, in the opinion of the trainer, not in a condition to exercise. Rescheduling of the session will be at the discretion of Tracey Mellor Pilates.
If the trainer feels that a participant is tired or it will not be in their best interest to continue then the session is deemed to have been completed.
The trainer can ask a participant to leave the studio immediately and no refund given if there is any inappropriate or dangerous behaviour.
Consideration to others, in and around the studio premises, is expected by all participants at all times.
All trainers will respect the participant’s privacy and do no harm.
All trainers will abide by their associations code of conduct.
If for any reason the studio has to close, all scheduled classes will be rescheduled or refunded, as much notice as possible will be given. If studio has to close at short notice (24 hours) it is the studio’s responsibility to contact anyone who has a class scheduled by phone/text/email with the information provided. . It is not the studio’s fault if the communication is not received/read.
It is the participant’s responsibility to check the on-line booking system for future studio closures.
